Why Greek Families Are Choosing U.S. Surrogacy

In Greece, gestational surrogacy is permitted under law, but only under specific conditions and with prior judicial approval before embryo transfer. Greek surrogacy must meet strict medical criteria, be altruistic and be overseen by the courts, which can make the process slower and more complex for some families.

For many Greek parents, especially those living abroad, pursuing surrogacy in the United States offers clear legal pathways, predictable timelines and comprehensive documentation support. At Joy of Life, we help Greek families navigate every stage of U.S. surrogacy with clarity, personalized care and dedicated guidance.

Surrogacy Law in Greece: What You Should Know

Greece permits gestational surrogacy under a formal legal process, governed primarily by Article 1458 of the Greek Civil Code. While legal, the system is far more restrictive than the regulated, parent-focused surrogacy process available in many U.S. states.

Altruistic surrogacy is permitted.

Under Greek law, surrogacy arrangements must be altruistic only. Intended parents may reimburse the surrogate for pregnancy-related expenses, but no commercial compensation is allowed.

Judicial authorization is required in advance.

Before beginning treatment, intended parents must obtain court approval confirming medical necessity and meeting legal consent requirements. This adds time and legal complexity.

Process and interpretation may vary by court.

While surrogacy is permitted under Greek law, the legal process requires judicial approval, which can differ between courts. This can introduce uncertainty and delays that many Greek parents prefer to avoid by pursuing U.S. surrogacy instead.

The U.S. offers a clearer path to parenthood.

At Joy of Life, we provide a fully supported surrogacy experience grounded in U.S. law, where parentage is established pre-birth, documentation is streamlined and your rights as parents are fully protected.

Understanding U.S. and Greek Citizenship for Your Baby

When your baby is born in the United States through surrogacy, they will automatically receive U.S. citizenship at birth. This allows for smooth documentation and travel preparation after delivery.

Greek parents may also be able to claim citizenship for their child by descent. However, registering a foreign birth with Greek authorities will require translated documents, apostilles and formal applications through the nearest Greek consulate.

At Joy of Life, we guide you through every legal and logistical step, from securing a U.S. passport to ensuring your child is recognized by the Greek government and ready to return home with you.

Common Questions From Our Greek Families

International surrogacy involves many important steps. These are some of the most common questions we hear from Greek parents, plus how we help ensure each part of your journey feels supported and clear.

Can I bring my baby back to Greece after birth?

Yes. Once your baby receives a U.S. birth certificate and passport, we assist with the paperwork and coordination needed for travel and birth registration with Greek authorities.

How long will I need to stay in the U.S. after the birth?

Most Greek families remain in the U.S. for about 2–4 weeks after the birth to finalize documents and prepare for their return home.

Does Greece legally recognize surrogacy?

Yes, but only under specific conditions. Greek surrogacy law requires judicial pre-approval and allows only altruistic arrangements. U.S. surrogacy offers a more flexible and streamlined path for many families.

Will my baby have dual citizenship?

Your child will receive U.S. citizenship at birth. If at least one parent is a Greek citizen, your child may also be eligible for Greek nationality by descent. We help you navigate the registration process.

What if I don’t speak English fluently?

No problem. We provide translation support and multilingual staff to ensure you feel confident and informed at every stage.
