Taiwan Surrogacy Law: What You Need to Know

Before beginning your surrogacy journey, it’s essential to understand the legal landscape both in Taiwan and the United States. This section provides a high-level overview of the laws, requirements and potential challenges Taiwanese families may face and how Joy of Life is here to guide you through each one.

Surrogacy is currently not legal in Taiwan.

Taiwanese law prohibits commercial and non-commercial surrogacy within its borders. While legislative discussions are ongoing, international surrogacy remains the only viable path for many families.

Children born abroad via surrogacy can typically be registered in Taiwan.

If at least one parent is a Taiwanese national, your child may be eligible for Taiwanese nationality by descent. However, recognition can involve additional steps, such as translated documents, embassy filings or household registration.

Parentage may require extra documentation.

Taiwan does not have specific legal protections for intended parents via international surrogacy. Depending on your case, DNA testing or legal affidavits may be required to establish parent-child relationships for registration purposes.

We help you navigate it all.

Understanding U.S. and Taiwanese Citizenship for Your Baby

When your baby is born in the U.S. through surrogacy with Joy of Life, they will almost always receive U.S. citizenship at birth. If at least one parent holds Taiwanese citizenship, your child may also be eligible for Taiwanese nationality by descent.

However, Taiwan’s nationality and household registration laws are complex and can vary based on your situation. Our team will guide you through every step, from applying for your baby’s U.S. passport to preparing documents for recognition and registration in Taiwan. While many families hold both nationalities, eligibility for dual citizenship is subject to the latest U.S. and Taiwanese laws.

We’ll help you explore the best path forward legally, ethically and with your family’s future in mind.

Common Questions From Our Taiwanese Families

Can I bring my baby back to Taiwan after birth?

Yes. Once your baby receives a U.S. birth certificate and passport, we assist with the necessary documentation and embassy coordination for returning to Taiwan.

How long will I need to stay in the U.S. after the birth?

Most Taiwanese families stay for about 2–4 weeks after delivery. This allows time to finalize your baby’s documents and begin the registration process before returning home.

Does Taiwan legally recognize surrogacy?

While Taiwan does not permit surrogacy domestically, children born abroad through surrogacy can typically be registered through a formal documentation process. We help guide that process.

Will my baby have dual citizenship?

Your child will receive U.S. citizenship at birth. If one parent is a Taiwanese national, your child may also be eligible for Taiwanese nationality by descent. We’ll help clarify what’s required based on your case.

What if I don’t speak English fluently?

You don’t need to. Our Mandarin-speaking staff provides full translation support, from consultations to medical and legal appointments.
